1. HOW TO PLAY: The Promotion entry period begins at 9:00 a.m. PST on February 4, 2013, and ends at 11:59 p.m. PDT on July 7, 2013 (the “Promotion Period”). You may participate by visiting http://www.rhinolinings.com/25years and submitting on that website all of the required information requested. Only one entry per person will be allowed. Winners will be selected from entries properly submitted and timely received during the Promotion Period, as described in more detail in Section 4 below (Selection of Promotion Winners/Odds). Promotional Winners will be informed instantly by email upon submission of entry.
2. ELIGIBILITY: The sponsor of this Rhino Linings Survival of the Toughest Giveaway (the “Promotion”) is Rhino Linings Corporation (“Rhino”). The Promotion is open only to U.S. and Canada residents (except residents of Quebec and Puerto Rico) who must be 18 years of age or older on the day of registration. All applicable federal, state and local laws and regulations apply. Void where prohibited by law. Entry in the Promotion constitutes your full and unconditional acceptance of these Official Rules. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. A CORRECT ANSWER TO A SKILL TESTING QUESTION IS REQUIRED BY EACH RHINO LININGS SURVIVAL OF THE TOUGHEST GIVEAWAY WINNER WHO IS A CANADIAN RESIDENT. Internet access and a valid email address will be required to participate in this Promotion. By participating in the Promotion, you unconditionally accept and agree to comply with and abide by these Official Rules and the decisions of Rhino, which will be final and binding with respect to all aspects of the Promotion. 3. EXCLUDED PERSONS: The following persons are ineligible to participate in the Promotion: all employees of Rhino, employees of each of Rhino’s subsidiaries and affiliates, and employees of each of Rhino’s sales representatives, distributors, applicators, contractors, licensees and agents, and their immediate family members including spouse, parent, child, sibling and those living in the same household of each, whether or not related.
Entries generated by robots or scripts or other automated devices are prohibited and will result in the immediate and automatic disqualification of any and all associated entries.
Limit one (1) entry per person and per email address during the Promotion Period, regardless of whether a person has more than one address or more than one person uses the same address.
No anonymous entrants will be eligible to win prizes. Entrants who submit incomplete entry forms or who submit incorrect addresses, emails or other required information will be ineligible. Potential winners who do not fully or timely comply with the Official Rules will be disqualified.
4. SELECTION OF PROMOTION WINNERS/ODDS:
Everyone is a winner. Eligible entrants will be instantly awarded by email one or the other following prizes: $25.00 discount promotional coupon or Grand Prize coupon. A total of five (5) Grand Prize winners will be determined by a pre-programmed, blind database formula.
Other than the Grand Prize winners, all eligible entries will be awarded a Promotional Coupon for a $25.00 discount off a Rhino Linings truck bed liner.
Until a selected winner is verified to be eligible and in compliance with these Official Rules (“Verification”), the potential winner is, and will remain, a potential winner.
If a potential winner is determined by Rhino to be ineligible or disqualified, or the prize is returned as unclaimed or undeliverable to any potential winner, the prize will be forfeited.
Odds of Winning
Every eligible participant will be awarded either one or the other of the following types of prizes listed below. Each of these prizes is described in more detail in Section 5.
1. Promotional Coupon - $25.00 discount: Every eligible entrant (other than the Grand Prize winners) participating in this promotion will receive a coupon good for a $25.00 discount off a Rhino Linings truck bed liner at participating Rhino Linings businesses (1:1).
2. Grand Prize: Five (5) persons participating in this promotion will be awarded a coupon good for one Free Rhino Linings Standard sprayed-on truck bed liner application (as described in Section 5 below). The odds of winning will depend on the number of eligible entries received during the Promotion, but Rhino estimates the approximate odds of winning for each entrant will be 1:2000.
5. PRIZES:
Promotional Coupon: $25.00 discount off a Rhino Linings truck bed liner. The Promotional Coupons will all be awarded to eligible participants by email only.
Grand Prize: One Free Rhino Linings Standard sprayed-on truck bed liner application (ARV of $469). Winner will receive a free Standard sprayed-on truck bed liner application. The Standard truck bed liner is defined as a black bed liner coating, under-the-rail application for a truck bed not to exceed six and one-half (6.5) feet in length. Prices vary among regions and among participating businesses. Grand Prize winners must pay additional costs for any upgrade beyond the free Rhino Linings Standard truck bed liner.
Prizes will not be replaced if lost or stolen. Prizes are not transferable and are not redeemable for cash. All taxes and incidental charges are the responsibility of the winner. No substitutions allowed by winners, except at the sole and absolute discretion of Rhino. All prizes are awarded by Rhino Linings Corporation, and not by independently owned and operated Rhino Linings businesses.
Rhino will be responsible to pay only the costs and expenses specifically attributable to Rhino in these Rules. All other costs and expenses are solely the winner’s responsibility. For example and not as a limitation, any costs associated with extra preparation work on truck bed caused by rust, damage, or paint other than factory original shall be the sole responsibility of the winner.
6. CONDITIONS: Rhino and all related parties shall have no liability for entries that are incomplete.
NOTE: The email address provided in the online registration (or in a Prize Claim) is the address that will be used by Rhino to communicate with participants and potential winners. If a reply is not received or if a prize is returned as unclaimed or undeliverable to any potential winner, that prize will be forfeited.
The Rhino Linings Survival of the Toughest Giveaway winners will redeem their Grand Prize by sending an email to rhinomarketing@rhinolinings.com. The subject line must state “Rhino Linings Survival of the Toughest Grand Prize Redemption” within thirty (30) days after transmittal to winners. If Rhino does not receive the email within the thirty (30) day timeframe, the Grand Prize will be forfeited.
After receipt of the redemption email by Rhino, the Rhino Linings Survival of the Toughest winners will be emailed the Publicity Release, a Declaration of Eligibility, a skill-testing question (if winner resides in Canada), and such other documents as may be determined by Rhino (the “Rhino Linings Survival of the Toughest Grand Prize Claim Documents”). All of the Rhino Linings Survival of the Toughest Grand Prize Claim Documents must be completed and returned to Rhino within ten (10) days after such documents are emailed by Rhino in order to claim the Rhino Linings Survival of the Toughest Grand Prize. If all of the Rhino Linings Survival of the Toughest Grand Prize Claim Documents are not returned to Rhino within such time period, the Rhino Linings Survival of the Toughest Grand Prize is forfeited. The Verification of the Rhino Linings Survival of the Toughest Grand Prize will require the potential winner to submit his/her U.S. Social Security number or Canadian Social Insurance Number.
Online claims require a printer in order to print the Rhino Linings Survival of the Toughest Grand Prize Claim Documents for necessary signatures. The Rhino Linings Survival of the Toughest Grand Prize Claim Documents must be submitted to Rhino by email [rhinomarketing@rhinolinings.com] or by fax [858-450-5078] by no later than ten (10) days after such documents are emailed by Rhino. If Rhino so elects, a potential Rhino Linings Survival of the ToughestGrand Prize winner may be required to submit to, and cooperate in, a confidential background check to confirm eligibility and to help ensure that the use of any such person in advertising or publicity for the Promotion will not bring Rhino into public disrepute, contempt, scandal or ridicule or otherwise reflect unfavorably on the Promotion or Rhino as determined by Rhino in its sole discretion.
Upon completion of Verification (as defined below), Rhino will email the winner the Free Truck bed liner coupon or notify the potential winner that he/she is not eligible to receive the Rhino Linings Survival of the Toughest Grand Prize.
All promotional coupons will be sent to winners via email, will be date stamped, and will be valid for thirty (30) days after transmittal to winners. Promotional coupons have no cash value, and shall become void thirty (30) days after transmittal to winners.
Winning any Prize requires that the winner of the Prize is, and remains, in compliance with these Official Rules. Until a potential winner is verified to be eligible and in compliance with these Official Rules (“Verification”), the potential winner is, and will remain, a potential Prize winner.
7. REDEMPTION
Promotional Coupon: $25 discount off a Rhino Linings truck bed liner is redeemable only at participating Rhino Linings businesses. All Rhino Linings businesses are independently owned and operated. Promotional discount coupon will not be honored for Rhino Linings sprayed-on applications made before receipt of the promotional coupon.
Grand Prize: After approval of completed Rhino Linings Survival of the Toughest Grand Prize Claim Document, you will receive one (1) Free Rhino Linings Standard sprayed-on truck bed liner application coupon via your email address provided in the online registration. Redeem this coupon only at participating, independently owned and operated Rhino Linings businesses. Winner may redeem from any participating Rhino Linings business. Promotional coupon will not be honored for Rhino Linings Standard sprayed-on truck bed liner application installed before receipt of the promotional coupon. Please visit www.rhinolinings.com and enter your zip/postal code as directed to obtain contact information for independently owned and operated Rhino Linings businesses near you.
Any and all federal, state, provincial and local taxes on purchases associated with discount coupons or prizes, if applicable, are the sole responsibility of the coupon recipient. Tax forms may be issued, if applicable.
8. LIMITATIONS ON LIABILITY: Rhino is not responsible for: (1) any incorrect or inaccurate information or technical failures of any kind involving the Promotion, (2) unauthorized human or electronic intervention in any part of the entry process or the Promotion; or (3) any other computer, network, technical, human or other error, problem or malfunction that may occur in connection with the administration of the Promotion, the processing of entries, or the selection or notification of winners. In the event of any such occurrence that affects the administration, fairness, integrity, safety or proper conduct of the Promotion, Rhino reserves the right, in its sole discretion, to terminate, modify or suspend all or any part of the Promotion.
By participating in the Promotion each participant hereby releases and agrees to hold Rhino and its officers, directors, employees and agent harmless from and against any and all costs, injuries, losses or damages of any kind, including, without limitation, property damage, death and bodily injury (whether due to negligence or otherwise), due in whole or in part, directly or indirectly, to participation in the Promotion or any Promotion-related and/or travel-related activity, or participation in any prize-related activities, or the receipt, use or misuse of any prize.
THE PRIZES WILL BE MADE AVAILABLE “AS IS”, WITHOUT WARRANTY OF ANY KIND. RHINO DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, CONCERNNG THE PROMOTION OR ANY PRIZE IN CONNECTION WITH THE PROMOTION, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
Under no circumstances will you or Rhino be liable to each other for any indirect, special, incidental, or consequential damages arising out of or related to the prizes or this Promotion, even if advised of the possibility of such damages. Without limiting the foregoing, Rhino’s maximum liability in any event will not exceed the total of the value of the prizes plus the actual out of pocket expenses you incurred for entering this Promotion.
SOME STATES OR JURISDICTIONS DO NOT ALLOW EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
9. PUBLICITY LICENSE GRANT: As a condition of entry into the Promotion, you grant and assign to Rhino the perpetual, royalty-free, worldwide right and license (but not the obligation) to the use of your name, city, state, voice, likeness, and any statements made by or attributed to you, without notice, review or approval, in perpetuity and (collectively, “Licensed Rights”) in any print, broadcast, internet and other electronic media now or hereafter known, for advertising, publicity and other commercial purposes, without your additional review, compensation, permission or approval, and you hereby release Rhino from any liability with respect thereto.
You agree that the opportunity to win a prize in this Promotion constitutes adequate and satisfactory consideration for the license granted above in this Section 9.
Without limiting the general license granted above, Rhino may post (or not post) all or any portion of the Licensed Rights (in each case, edited or unedited) on the Rhino Website, http://www.rhinolinings.com and/or on Rhino’s social media pages that may include but are not limited to the Rhino Facebook page, http://www.facebook.com/rhinolinings, the Rhino YouTube page, http://www.youtube.com/rhinolinings, and the Rhino LinkedIn page, http://linkedin.com/company/Rhino-Linings.
10. PRIVACY: The personal information collected through the Promotion is subject to these Official Rules. By entering the Promotion, you agree to the use of your personal information as described in the Rhino Privacy Policy at http://www.rhinolinings.com/information/privacy-policy.
11. GENERAL RULES: By entering or participating in the Promotion, you agree to be bound by these Official Rules, and by the decisions of Rhino, which are final and binding in all respects.
Rhino reserves the right at its sole discretion to disqualify the entry of any individual found to be (a) tampering or attempting to tamper with the entry process or the operation of the Promotion or any website operated by Rhino; (b) using any robotic, macro, automatic, programmed or similar entry methods, which will void all such entries; (c) violating these Official Rules or the terms of service, conditions of use, and/or general rules of any Rhino property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person.
All Promotion entries, including testimonials and photos, will become the property of Rhino, and all rights therein are hereby assigned by entrants to Rhino. Rhino shall not be required to return all or any portion of any Promotion entry or attachment/enclosure.
12. WINNERS' LIST REQUESTS: To obtain a copy of list of the Rhino Linings Survival of the Toughest Giveaway Prize winners, send a self-addressed stamped envelope to: Rhino Linings Survival of the Toughest Giveaway Winners List Request, 9151 Rehco Road, San Diego, CA 92121. Requests for winners' lists must be received within three months after the end of the Promotion Period.
13. OFFICIAL RULES REQUEST: For a paper copy of the Official Rules for this Promotion, send a self-addressed, stamped #10 envelope (postmarked no later than three months after the end of the Promotion Period) to: Rhino Linings Corporation “Rhino Linings Survival of the Toughest Giveaway” Official Rules Request, 9151 Rehco Road, San Diego, CA 92121.
14. DISPUTES: THIS PROMOTION IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Promotion, each participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Promotion shall be resolved individually, without resort to any form of class action, exclusively before a federal or state court located in San Diego County, California.
